Privity AI, Corp. ("Privity," "we," "us," or "our") is committed to protecting your personal information and informing you about how we use it. This privacy policy ("Privacy Policy" or "Policy") is intended to provide information to our users ("you" or "your") about how we collect, protect, share, and use your information when you use our mobile application (the "App") and any products and services offered through the App (collectively, the "Services"). Any capitalized term not defined in this Privacy Policy shall have the meaning given to it in the Terms of Service.

  • Generative Content: Our Services produce outputs based on your inputs. If you include personal data in your inputs, we will collect that information, which may be reproduced in the outputs.
  • Feedback: We may collect your feedback regarding the generated content and use it to train and improve our Services.

1.2 Automatically Collected Information

  • Log Data: When you use our Services, our servers may automatically log information provided by your device, such as your device's IP address, browser type, pages visited, time and date of your visit, and other details about your usage.
  • Device Data: We may automatically collect data about your device, such as device type, operating system, unique device identifiers, device settings, and geo-location data.

We may collect personal information from you when you:

We may collect, hold, use, and disclose information for the following purposes:

  • To comply with legal obligations and to protect the rights, privacy, safety, or property of our users, us, our affiliates, or any third party (Legal basis: To comply with a legal obligation)

3. Children's Privacy

Our Services are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. If a parent or guardian becomes aware that their child has provided us with personal information without their consent, they should contact us at [email protected]. We will delete such information from our files as soon as reasonably practicable.

4. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We consider criteria such as the nature of the data, your interactions with Privity, and our legitimate interests and legal obligations when determining retention periods.

For Generative Content, we may automatically delete it within 90 days of receipt or generation. We may also use the Generative Content to train our models, unless you email us at [email protected] with instructions not to do so.

5. Disclosure of Personal Information to Third Parties

We may disclose your personal information to:

  • Our parent company, subsidiaries, or affiliates for purposes consistent with this Privacy Policy
  • Service providers who perform services on our behalf, such as hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services
  • Law enforcement, government officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar legal procedure, or when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of our Terms of Service
  • Third parties in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company
  • Third parties with your consent or at your direction, including if we notify you that the information you provide will be shared in a particular manner and you provide such information

We may also share aggregated or de-identified information that cannot reasonably be used to identify you.

6. International Data Transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident, including to the United States where our servers are located. These countries may have data protection laws that are different from the laws of your country.

We have taken appropriate safeguards to ensure that your personal information will remain protected in accordance with this Privacy Policy, including:

  • Implementing the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers
  • Relying on third-party providers' certification to the EU-US and Swiss-US Privacy Shield Frameworks where applicable

  • Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you

8. Data Security

We have implemented appropriate technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet or method of electronic storage is 100% secure, so we cannot guarantee its absolute security.

We may update this Privacy Policy from time to time in response to changing legal, technical, or business developments. When we update our Privacy Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Policy changes if and where this is required by applicable data protection laws.
